The application is for grant of bail for the offence under Sections 414 of the Indian Penal Code as well as Section 25 (1B)A/26/35 of the Arms Act. It is submitted on behalf of the petitioner that nothing has been recovered from the possession of the petitioner rather it has been recovered from the other co-accused and the petitioner has been falsely implicated in this case.
Heard learned A.P.P. also, who has pointed out that there are six cases pending against the petitioner, which appears from Para No.3 of the application.
Having heard both sides. In view of the fact that the petitioner is in custody for two years in connection with this case,
Patna High Court Cr.Misc. No.55441 of 2016 (2) dt.23-12-2016 2/2 let petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Lalan Ji, J.M Ist class, Saharsa in connection with Sour Bazar P.S.Case No.563 of 2014, with condition that one of the bailer must be a close relative of the petitioner having sufficient means under the jurisdiction of the court below and with further condition that he will co-operate in disposal of the trial and will not absent himself without any genuine reason.
