1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application has been filed for modification of the order dated 25.02.2025 passed in Cr. Misc. No. 3312 of 2025, whereby the present petitioner has been granted privilege of anticipatory bail subject to the condition that the petitioner shall surrender before a learned Court below within a period of four weeks from the date of the order.
3. Learned counsel for the petitioner submits that in the order dated 25.02.2025 passed in Cr. Misc. No. 3312 of 2025, inadvertently, in the 3rd page of the order at paragraph 7, the description of the Court below has been typed as "to satisfaction of learned Special Judge, Excise Act, 1st Araria, Bihar in connection with Bairgachhi Police Station Case No. 84/2024" instead of "to
Patna High Court CR. MISC. No.26073 of 2025(2) dt.25-04-2025 2/2 satisfaction of learned Spl. Judge IInd, Excise Act, Patna in connection with Pipra Police Station Case No. 72 of 2018 in Spl. Case No. 7737 of 2018", as such, he could not surrender before the learned District Judge within the time granted by this Court. He, accordingly, prays for further two weeks' time to surrender before the learned District Court.
4. Having regard to the submission made on behalf of the petitioner, let the description of the Court below be read as: "to satisfaction of learned Spl. Judge IInd, Excise Act, Patna in connection with Pipra Police Station Case No. 72 of 2018 in Spl. Case No. 7737 of 2018" and let the time granted by this Court to surrender before the learned Court below by order dated 25.02.2025 passed in Cr. Misc. No. 3312 of 2025 be extended by further two weeks from today.
5. Accordingly, this application is allowed to the extent indicated above.
