This application has been filed for modification in the order dated 22.12.2016 passed in Criminal Misc. No.44764 of 2016 by this Court with regard to extend the period of surrender of the petitioner in the court below.
Learned counsel for the petitioner submits that vide order dated 22.12.2016 passed in Criminal Misc. No.44764 of 2016 by this Court, the petitioner, in the event of his arrest or surrender by him within six weeks from that date, was directed to be enlarged on bail, on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each
Patna High Court Cr.Misc. No.14230 of 2017 (2) dt.12-04-2017 2/2 to the satisfaction of Sri Ravi Ranjan, Judicial Magistrate, First Class, Patna, in connection with Complaint Case No.1209(C) of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. but as the petitioner was under treatment, he could not surrender in the court below within the above stated period and prays for modification in the order dated 22.12.2016 passed in Criminal Misc. No.44764 of 2016 by this Court with regard to extend the period of surrender of the petitioner in the court below in connection with the aforesaid case.
In that view of the matter, the period of surrender of the petitioner in connection with the aforesaid case in the court below is further extended for a period of four weeks from today. The order dated 22.12.2016 passed in Criminal Misc. No.44764 of 2016 by this Court is modified to the above extent only.
This application is, accordingly, allowed.
