The petitioner being the husband of the informant is languishing in custody since 23.08.2016 in a case registered for the offences punishable under sections 341, 323, 498A, 504, 506/34 of the Indian Penal Code.

Accusation is of torture. It is alleged that the informant was married with the petitioner two years prior to lodging of the case, but subsequently, further dowry demand of Bolero vehicle was made and non-fulfillment of the same torture was inflicted. The father-in-law of the informant used to assault the informant in inebriated condition. On 10.06.2016 the husband of the informant pushed her in the courtyard and tied her legs and hands by rope when sister-in-law

Patna High Court Cr.Misc. No.44637 of 2016 (2) dt.25-10-2016 2/2 of the informant brought kerosene oil and father-in-law poured the kerosene oil on her body and mother-in-law brought match box to ignite fire. On alarm being raised, when the villagers came the informant could be saved.

It is submitted by learned counsel for the petitioner that no injury was caused to the informant and the petitioner is still ready to keep the informant as wife with full dignity and honour. A statement to that effect has been made in paragraph no.12 of the petition, which reads as under :- "That the petitioner is still ready to keep the informant with all dignity and honesty."

Considering the nature of accusation and present stand, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Bettiah, West Champaran in connection with Dhanaha P.S. Case No.101/2016.
