JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 12-04-2017 Heard the learned counsel for the petitioner, the learned A.P.P. for the State as also the learned counsel for the opposite party no.2.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Forbesganj P.S. Case No. 567 of 2016 for the offences punishable under sections 341, 323, 307 and 498 (A)/34 of the I.P.C and section 3⁄4 of the Dowry Prohibition Act.

The learned counsel for the petitioner submits that the petitioner is ready to keep the opposite party no.2 as his wife with honour and dignity. The learned counsel for the opposite party

Patna High Court Cr.Misc. No.6758 of 2017 (3) dt.12-04-2017 2/2 no.2 also submits that the opposite party no.2 is ready to live with the petitioner in case he will keep her with honour and dignity. Under the circumstances, both parties are directed to appear before the learned court below on 05.05.2017 and on that date the opposite party no.2 will go with the petitioner to live together and the petitioner and opposite party no.2 both will file affidavit in this regard in the court below. The court below will assess the development after calling them within fortnight and in case the petitioner keeps the opposite party no.2 as his wife with honour and dignity then he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each and till then no coercive steps shall be taken against the petitioner in connection with the aforementioned case pending in the court of C.J.M. Araria and if the petitioner will fail in keeping the opposite party no.2 as his wife, the bail granted to him shall be deemed to be cancelled.
