JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 471 and 34 of the Indian Penal Code.

It is alleged against the petitioner that the petitioner took Kisaan credit loan of Rs.5,00,000/- from UCO Bank Khagaria but subsequently, it was found that the document of the same land was also mortgaged in the State Bank of India and from there also loan was obtained.

It is submitted by learned counsel for the petitioner that petitioner has repaid the loan amount of both the banks i.e. UCO bank and State Bank of India.

Considering the aforesaid fact, let the above named petitioner be released on provisional anticipatory bail for three

No.37654 of 2015 (2) dt.17-09-2015 2/2 months, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Khagaria in connection with Khagaria P.S. Case No.87 of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C. The provisional bail of the petitioner will be confirmed by the learned court below on getting it verified from the UCO bank and State Bank of India that entire liability has been cleared by the petitioner.
