JUSTICE SANDEEP KUMAR ORAL ORDER 22-04-2025 Heard the learned counsel for the petitioner, learned APP appearing for the State and the learned counsel for the O.P. No. 02.

2. Learned counsel for the O.P. No. 02 prays for and is permitted to file counter affidavit in the matter and the same is taken on record.

3. This is an application for quashing of the order dated 17.8.2018 and 18.8.2018 passed by the Special Judge, PESU Area, Patna in Special Case No. 1013 of 2013 arising out of Kankarbagh P.S. Case No. 396 of 2013 by which petition udner Section 239 of Cr.P.C. and the supplementary petition dated 25.07.2018 filed on behalf of the petitioner was rejected.

4. The petitioner has already deposited the amount in dispute with the electricity company.

5. The learned counsel for the O.P. No. 02 has submitted that the petitioner may be directed to approach the Electricity Company for compounding and the Electricity Company will act in accordance with law.

6. If the matter is compounded, the petitioner is bound to succeed in the Court below.

7. Till the decision in compounding matter is taken by the Electricity Company, the further proceedings in the Court below in connection with Kankarbagh P.S. Case No. 396 of 2013 shall remain stayed.

8. With the aforesaid observation and direction, this application is disposed of.
