JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 22-02-2017 Heard learned counsel for the petitioner as well as learned APP for the State.
Learned Addl. P.P. has placed letter no.106 dated 20.02.2017 of Superintendent of Police, Madhubani wherefrom it is evident that all the witnesses including the Doctor had already been examined.
That being so, now the ball has gone to the court of the accused-petitioner. In the aforesaid eventuality, learned lower court is directed to conclude the trial within four months in case there happens to be active co-operation at the end of the petitioner..
So far merit of the case is concerned, in the aforesaid facts and circumstances, I do not see any cogent reason to
Patna High Court Cr.Misc. No.40040 of 2016 (7) dt.22-02-2017 reconsider the plea of the petitioner. Consequent thereupon, the instant petition is rejected.
