The petitioner seeks bail in connection with Uda Kishunganj P.S. Case No. 119 of 2016 registered for the offences punishable under Sections 457, 380, 511 of the Indian Penal Code and Sections 25(1-b)a, 26 of the Arms Act. The allegation against the petitioner is that the petitioner was apprehended with a country made pistol, 05 live cartridges, cash of Rs. 19,790/-, a big screen touch mobile and a small mobile of Samsung Company.
It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case and so far the allegation under Sections 25(1-b)a and 26 is concerned, the
Patna High Court Cr.Misc. No.54706 of 2016 (2) dt.20-12-2016 2/2 F.I.R. itself shows that nothing has been recovered by the police and the same has been handed over to the police by the informant. It has further been submitted that the petitioner has lodged a case against the informant of the instant case before the police vide Annexure-2 of the application and there is injury on the side of the petitioner also. The petitioner has no criminal antecedent and he is in custody since 18.08.2016. Heard the learned APP also.
Having heard both sides, in view of the fact that the petitioner has no criminal antecedent, he has lodged a case against the informant vide Annexure-2 of the application and he is in custody 18.08.2016, let the petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Sub Divisional Judicial Magistrate, Uda, Kishunganj, Madhepura in connection with Uda Kishunganj P.S. Case No. 119 of 2016.
