JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-03-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 498A, 504 and 506 of the Indian Penal Code.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that petitioner is still ready to keep his wife (O.P. no 2). During mediation before the court below opposite party no. 2 was not ready to live with him making allegation of cruelty. Heard learned A.P.P. also.

Having heard both sides and considering the allegation made, let petitioner surrender in the court below, i.e. Judicial Magistrate, Ist Class, Patna, in connection with Fulwari Sharif P.S. Case no. 18 of 2016 and file a petition with regard to

Patna High Court Cr.Misc. No.8785 of 2017 (2) dt.02-03-2017 2/2 the fact that still he is ready to keep his wife. On his surrender and filing such petition, learned court below will release petitioner on provisional bail to his own satisfaction and call the parties for mediation for final settlement and after watching the conduct of both the parties and also on the basis of result of the mediation pass an order either for confirmation of bail bond of the petitioner or any other order that the court below deems fit and proper. Accordingly, the present application stands disposed of.
