Petitioner seeks bail in connection with Bounsi P.S. Case No. 315 of 2017 registered for the offence punishable under section 392 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case on basis of confessional statement of the co-accused. The present first information report has been alleged after three days of the alleged occurrence without any explanation. Except the said confessional statement there is nothing against this petitioner. Similarly situated co-accused has been granted bail by this Court vide order dated 11.07.2018 passed in Cr. Misc.

Patna High Court Cr.Misc. No.61055 of 2018(2) dt.06-10-2018 2/2 No. 41600 of 2018.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, III, Banka in connection with Bounsi P.S. Case No. 315 of 2017.
