The petitioners seek bail in Jainagar Police Station Case No. 305 of 2018, registered for the offences punishable under Sections 272/276 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It appears from the statement made in the paragraph 3 of the application, that the petitioners have criminal antecedent inasmuch as they are accused in two other cases, both lodged in 2018, alleging similar offence as has been alleged in the present case. It is alleged in the first information report that 90 litres of foreign liquor was recovered, which, on investigation, was found to be belonging to these petitioners.
Patna High Court Cr.Misc. No.61866 of 2018(2) dt.06-10-2018 2/2 Considering the fact that the petitioners have criminal antecedents and from their possession, 90 litres of foreign liquor was recovered, I am not inclined to grant them privilege of bail. This application is, accordingly, rejected.
The petitioners shall be at liberty to renew their prayer for bail after six months.
