Petitioner seeks bail in Ujiyarpur P.S. Case No.134 of 2018, registered under Sections 272 and 273 of the Indian Penal Code as well as under Section 47, 30(a), 38(1), (2) of the Bihar Prohibition and Excise Act.

The informant alleged that 114.840 litres of different brands of Indian made foreign liquor is said to have been recovered from behind and in front of the house of the petitioner.

The learned counsel for the petitioner submits that the liquor was recovered from different place situated near the house and the same cannot be said to have been recovered from conscious possession of the petitioner. The police did not obtain the signature of the any of the family member of the petitioner

Patna High Court Cr.Misc. No.61452 of 2018(2) dt.06-10-2018 2/2 on the seizure list. Petitioner is in jail since 11.07.2018. Considering the facts aforesaid and the fact that the petitioner has already remained in jail for three months, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cum-Special Judge, Excise, Samastipur in connection with Ujiyarpur P.S. Case No.134 of 2018.
