JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-03-2015 Heard learned counsel for the petitioners and learned counsel representing the State.
Petitioners apprehend their arrest in connection with Darbhanga Mahila P.S. Case No. 23 of 2014 registered for the offences punishable under Sections323, 342, 448, 380, 376/511/34 of the Indian Penal Code.
Allegedly, the petitioners entered into the house of the informant and on protest, they tied the husband of the informant, tried to commit rape upon the informant and thereafter, husband and father-in-law of the informant were assaulted. The petitioner Bechan Das took away golden chain from the informant and Bhogendra Das and Chhedi Das took away box in which
Patna High Court Cr.Misc. No.43305 of 2014 (2) dt.20-03-2015 clothes and cash Rs. 7,000/- were kept. The petitioner Sanjib Das snatched wrist watch from the husband of the informant. Submission is that the petitioners have falsely been implicated due to village politics, the husband of the informant used to sell illicit liquor and there was some altercation in between Bechan Das and informant's husband and thereafter, they have falsely been implicated to which the learned APP opposes. In the facts and circumstances stated above, the petitioners above named, in case of their surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Mahila P.S. Case No. 23 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
