JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-09-2015 Heard learned counsel for the petitioner, learned Assistant Public Prosecutor for the State and the learned counsel representing the informant.

This application for grant of anticipatory bail arises out of Jagdishpur PS Case No. 74 of 2015, disclosing offences under Sections 406, 409, 323 and 120B of the Indian Penal Code. The petitioner is said to be the Chairman of Primary Agricultural Credit Co-operative Society, Bhojpur. It is alleged that the amount which was deposited in the account of the informant by the agent of the Co-operative Bank was withdrawn by the petitioner, and on enquiry, the informant was stated that no money was lying in his account. It is submitted on behalf of the petitioner that he has no role to play in the matter of deposit of any amount in the bank account.

Patna High Court Cr.Misc. No.36907 of 2015 (2) dt.10-09-2015 2/2 Be that as it may, in view of the nature of the dispute and the allegation as contained in the FIR, this application is allowed.

Let the petitioner above named, in the event of his arrest or surrender before the Court below within six weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in Jagdishpur PS Case No. 74 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall liable to be cancelled.
