This is an application for grant of regular bail for offences punishable under Section 392 of Indian Penal Code. It has been submitted on behalf of the petitioner that he is not named in the F.I.R, his name transpired during the investigation on confessional statement of the co-accused. Nothing has been recovered from the possession of the petitioner and except confessional statement, there is nothing against the petitioner and he has been in custody since 27.08.2016. Heard learned A.P.P. also.
Having heard both sides. In view of the fact that from perusal of the impugned order, it appears that petitioner is not named in the F.I.R, he has been made accused in this case only on
Patna High Court Cr.Misc. No.55483 of 2016 (2) dt.23-12-2016 2/2 the basis of confessional statement made by a co-accused and the he has been in judicial custody since 27.08.2016, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Deo P.S. Case No. 17 of 2016.
