2. The petitioner seeks bail in connection with Matihani P.S. Case No. 163 of 2017 registered for the offence punishable under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. The petitioner is the assailant of the deceased. He has shot and killed the deceased.

4. The petitioner is in custody since 24.09.2025 having six antecedents also.

5. Considering the fact that the petitioner is the assailant who has shot and killed the deceased and also the fact that the petitioner has six criminal antecedents of serious nature, I am not inclined to grant bail to the petitioner.

6. Accordingly, the application stands dismissed.

7. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not express any opinion on the merits of the case.
