This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 379, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner referring to the First Information Report has submitted that there is no allegation against the petitioner of commission of offence under Section 27 of the Arms Act. He has further submitted that the allegation against the petitioner is that he gave Farsa blow on the head of the informant. Learned counsel for the petitioner submits that the prosecution case cannot be supported by the injury report. He further submits that the petitioner has no criminal antecedent and there is no chance of petitioner absconding from the course of trial.
Having considered the submissions made above, let the
Patna High Court Cr.Misc. No.43123 of 2014 (2) dt.20-03-2015 2/2 petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Vaishali P.S. Case No. 36 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
