Petitioner is accused in connection with Kanti P.S. Case No. 319 of 2014 registered under Sections 302, 201 and 120B of the I.P.C. and later on, section 27 of the Arms Act was added.
Learned counsel appearing on behalf of the petitioner submits that petitioner, being the Assistant Teacher of the Govt. Middle School, has falsely been made accused in this case on the basis of suspicion. Except suspicion, there is nothing against the petitioner to show his involvement in the case. It is also submitted that there is no direct evidence of the alleged occurrence. Further submission is that similarly situated co-accused namely Atiquer
Patna High Court Cr.Misc. No.53476 of 2016 (8) dt.17-03-2017 2/2 Rahman @ Lal Babu @ Atikur Rahman has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 25551 of 2015 and petitioner is in custody since 20.10.2016. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., West, Muzaffarpur in connection with Kanti P.S. Case No. 319 of 2014.
