====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-07-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioner is in jail custody since 03.06.2019 in connection with Bounsi P.S. Case No. 260 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code.

Petitioner is not named in the first information report and it appears from perusal of impugned order that petitioner was arrested and remanded from another case. Furthermore, impugned order goes to show that name of petitioner also appeared in confessional statement of co-accused Chandan Yadav.

Patna High Court CR. MISC. No.20352 of 2020(2) dt.16-07-2020 2/2 No doubt, petitioner does have criminal antecedent of five cases but except the above stated materials, there appears to be nothing against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Bounsi P.S.
