JUSTICE SUDHIR SINGH ORAL ORDER 04-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 341, 323, 384, 386, 387 and 504 of the Indian Penal Code and Sections 25(1-B) A/26 and 35 of the Arms Act. Allegation against petitioner is that he assaulted informant and his brother and one loaded pistol pointed upon them.

It has been submitted on behalf of petitioner that he is in custody since 17.6.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. Petitioner has falsely been implicated in the present case. Informant is neighbour of petitioner. A Title Suit is also pending between the parties. Alleged recovery of arms is denied by petitioner.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like

Patna High Court Cr.Misc. No.42316 of 2016 (2) dt.04-10-2016 2/2 amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Sadar Saharsa P.S. Case no. 515 of 2016.
