JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2018 The petitioner is in custody since 24.08.2018 in connection with Excise Case No. 253 of 2018, registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 06 liters liquor from the residential house of the petitioner.

Submission of learned counsel for the petitioner is that it is the joint house and the petitioner is a lady person, who is in custody since 24.08.2018.

Heard learned A.P.P. also.

Having heard both sides and considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.

Patna High Court Cr.Misc. No.63596 of 2018 (2) dt.25-10-2018 2/2 25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, VI Cum Special Judge, Excise, Samastipur, in connection with Excise Case No. 253 of 2018, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make herself available as and when required by the court and on the event of failure on her part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of her bail.
