JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-06-2020 Heard Mr. Manish Kumar No. 2, learned Advocate for the petitioner and APP for the State. The petitioner seeks bail in connection with Special Case No. 2044 of 2017, arising out of Economic Offences P.S. Case No. 04 of 2017 dated 10.03.2017 instituted for the offence under Sections 30(a), 32(1) and 38(1) of the Bihar Prohibition and Excise Act, 2016. It appears that approximately 768 litres of foreign liquor was recovered from a truck and two other vehicles. Six persons also were arrested. Some of the arrested accused persons have been granted bail as has been averred in the bail petition.

From the impugned order, it appears that during the course of investigation it came to light that

The petitioner has clean antecedents and he is in custody since 08.01.2020.

Regard being had to the nature of accusation against the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge-Excise Act, Patna in connection with Special Case No. 2044 of 2017, arising out of Economic Offences P.S. Case No. 04 of 2017.
