The petitioner has preferred this application for grant of regular bail in a case registered under section 9 of the Wild Life Protection Act and section 50(I)(III) of Bihar Forest Act. As per the prosecution case, the allegation against the petitioner and one another co-accused is of having hunted a deer and selling its meat.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No occurrence as alleged in the complaint took place. From the prosecution case itself it would transpire that on the search team visiting the alleged place of occurrence, the petitioner was found

Patna High Court CR. MISC. No.23099 of 2022(3) dt.11-01-2023 2/2 present at his agricultural land. The petitioner is in custody since 9.2.2022 and charge-sheet has been submitted in the case. Heard learned A.P.P for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the petitioner having remained in custody for 11 months since 9.2.2022 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Forest Case no. 3 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Dehri-on-Sone, Rohtas.
