JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 04-08-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under Sections 186, 188, 353, 379, 413 and 414 read with 34 of the Indian Penal Code and under Rules 56, 11 and 41 of Bihar Minerals Rules and u/s 4 and 21 of the Mines and Minerals Act and Section 15 of the Environment Protection Act.

As per the prosecution case, on seeing the police, the

Patna High Court CR. MISC. No.20981 of 2022(2) dt.04-08-2022 2/2 petitioner and co-accused persons fled away while they were loading sand on the tractor illegally.

Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case and he was arrested while doing agricultural work. The petitioner has clean antecedent as stated at para 3 of the bail petition. Learned counsel for the petitioner has further submitted that the said tractor does not belong to the petitioner. The petitioner is in custody since 03.03.2022.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Betiya, West Champaran in connection with Inarwa P.S. Case No. 10 of 2022. The application stands allowed.
