The petitioner seeks bail in connection with Kajra P.S. Case No.148 of 2022 registered for the offence under Sections 366A of the Indian Penal Code.

Allegation against the petitioner is to have taken away the daughter of the informant for the purpose of simonizing marriage.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case. It is submitted that it appears from perusal of Affidavit as submitted by both the parties that victim and this petitioner solemnized marriage and it also

No.23593 of 2024(2) dt.15-04-2024 2/2 appears from perusal of impugned order that the victim has stated in her statement as recorded under Section 164 of the Cr.P.C. that victim has already been married with the present petitioner. It is also submitted that from perusal of medical report the doctor found the age of the victim 18 years old. It is further submitted that petitioner is a man of clean antecedent and he is in custody since 10.11.2023.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Kajra P.S. Case No.148 of 2022 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-VI-cum-Special Judge, POCSO Act, Lakhisarai.
