JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-10-2018 Heard learned counsel for the petitioner and learned Addl. Public Prosecutor for the State. This application has been filed on behalf of the petitioner for modification in the order dated 12.09.2018 passed in Criminal Misc. No. 885 of 2018.

Learned counsel for the petitioner submits that, in fact, petitioner is accused in Sessions Trial No. 584 of 2009 arising out of Kharagpur P.S. Case No. 04 of 2005 pending in the Court of Addl. Sessions Judge-I, Munger, but inadvertently in petition filed in Criminal Miscellaneous No. 885 of 2018, Sessions Trial number wrongly typed in the second and last paragraphs as Sessions Trial No. 584 of 2005 in place of 584 of

Patna High Court Cr.Misc. No.60088 of 2018(2) dt.03-10-2018 2/2 2009. Due to that reason in order dated 12.09.2018 passed in Criminal Miscellaneous No. 885 of 2018 in second and last paragraph Sessions No. 584 of 2005 has been typed in place of Sessions Trial No. 584 of 2009.

In view of the above, the order dated 12.09.2018 passed in Criminal Misc. No. 885 of 2018 is modified to the extent that in the second and last paragraph of the aforesaid order dated 12.09.2018 passed in Criminal Miscellaneous No. 885 of 2018, the Sessions Trial No. 584 of 2005 be read as "Sessions Trial No. 584 of 2009".

With the aforesaid modification in order dated 12.09.2018 passed in Criminal Miscellaneous No. 885 of 2018, this application is allowed.
