The petitioner apprehends his arrest in Katihar Town (Sahayak) P.S. Case No. 484 of 2013 registered for the offences punishable under Sections 7/7(i)(a)(ii) of the Essential Commodities Act and 19 (c)(vi) of the Fertilizer Control Order. Learned counsel for the petitioner submits that the petitioner had earlier filed Cr. Misc. No. 42025 of 2015 for anticipatory bail but, the same was permitted to be withdrawn as the petitioner was on police bail and the police did not find the accusation true against the petitioner. After submission of final form, the learned court below took cognizance, therefore, the petitioner again filed this petition for grant of anticipatory bail. It appears that once the petitioner is on police bail, the

Patna High Court Cr.Misc. No.20493 of 2017 (2) dt.10-05-2017 2/2 anticipatory bail petition is not maintainable. Considering the facts aforesaid, the anticipatory bail petition is dismissed.
