62.5 Litres of Indian made foreign wine is said to have been recovered from the house of the petitioner while some other quantity is said to have been recovered from the house of Dharamraj Singh on a raid conducted by the informant. However, from the seizure list, it is evident that it does not bear the signature of either petitioner or his family members. Moreover, as per para3 of the bail petition, petitioner has got criminal antecedents and happens to be accused under Excise Act since before. In the aforesaid background, petitioner, Pappu Jaiswal is directed to be released on bail on deposit of cash surety of Rs. 25,000/- with a condition that in case, petitioner is found involved in Excise case subsequently, the aforesaid amount will be
Patna High Court Cr.Misc. No.52040 of 2016 (2) dt.02-12-2016 forfeited. Whereupon, his bail bond will be deemed to be cancelled. However, having absence thereof, will entitle the petitioner to have the aforesaid money received back, which the learned lower court will return on proper identification and after conclusion of the trial.
