The petitioner is the husband of the deceased and is facing prosecution under section 202 IPC vide K. Nagar(Sri Nagar) P.S. Case No. 287 of 2010 for having committed the murder of his wife.

From the impugned order and the submissions of the counsel for the petitioner, it appears that the case is under trial vide S.T.No. 97 of 2015. It is stated that some of the material witnesses have been examined in the case. However, prosecution witnesses have not been produced after 1st March, 2016. Considering the allegation and other materials evidenced from the record, I am not persuaded to extend him the privilege of bail. However, as the petitioner has remained in

No.47607 of 2016 (2) dt.08-11-2016 2/2 custody for 02 years and the trial has already been taken up, the Court grants liberty to renew his prayer for bail in the court below itself if the trial is not concluded within 06 months from the date of receipt/production of a copy of this order.
