The petitioner is apprehending his arrest in a case registered under Section 30(A) of the Bihar Excise (Amendment) Act, 2016.
The informant saw that two persons were keeping country made liquor in the shop of this petitioner. The occurrence allegedly took place on 16.12.2016.
This anticipatory bail is not maintainable in view of the provisions contained in Section 76 of the Bihar Prohibition and Excise Act, 2016.
Hence, the anticipatory bail application in connection with Nirmali P.S. Case No. 119 of 2016 pending in the court of learned S.D.J.M., Birpur (Supaul) stands dismissed as not maintainable.
