Petitioners seek bail in connection with Cheriyabariyarpur P.S. Case No. 155 of 2019 for the offence punishable under sections 302/120B/34/307 of the Indian Penal Code.

Informant in his written complaint has alleged that on 15.10.2019 at about 3:30 am while he was sleeping on the roof of his house and on noise he woke up and came down and saw FIR named accused along with two unknown persons who were holding the hands and legs of his father and accused Chandan Singh and Rajesh Kumar were assaulting on the head of his father with Katta and Khanti and when Informant raised alarm

Patna High Court CR. MISC. No.18102 of 2020(4) dt.06-04-2021 2/3 and saw accused Ranjan Singh (petitioner) and Hare Krishna Singh (petitioner) coming out from the room of his grandmother who fled away holding hammer and khanti in their hands. On account of raising of alarm by the Informant villagers assembled there and thereafter he went to see his father and grand-mother and found them dead and when he started searching for her mother he found his mother lying in an injured condition in the garden behind the house and thereafter she was admitted in a nearby nursing home where her condition is critical.

It has been submitted by learned counsel for the petitioners that they are innocent and have been falsely implicated in this case due to property dispute. Petitioners have got no criminal antecedent and are in custody since 16.10.2019. Considering the fact that statement of the mother of the Informant was recorded under Section 164 of Cr.P.C in which she has named both petitioners of assaulting her by hammer and khanti, and Informant has alleged in FIR that he saw petitioners running away from the room in which her grandmother was sleeping and was found killed, I am not inclined to enlarge the petitioners on bail.

Hence, the prayer for bail of the petitioners is hereby

Patna High Court CR. MISC. No.18102 of 2020(4) dt.06-04-2021 3/3 rejected.

However, the trial court is directed to expedite and conclude the trial at the earliest.
