====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 24-03-2017 Heard learned counsel for the petitioner, learned APP and learned counsel for the informant.

The petitioner apprehends his arrest in Raniganj P.S. Case No. 340 of 2016 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant named the petitioner along with other seven accused persons and alleged that they were abusing the informant and others. In the meantime on the order of Panchanand Mukhiya the petitioner is said to have assaulted Satya Narain Sah, cousin of the informant, with Pharsa on his head. Other accused persons also assaulted the informant and others. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case due to dirty

No.10883 of 2017 (2) dt.24-03-2017 2/2 village politics, but it appears that there is very specific allegation against the petitioner that he assaulted Satya Narain Sah with Pharsa on his head and the Sessions Judge, Araria in his order stated that the injury found on the head of Satya Narain Sah is opined to be grievous in nature. The petitioner is author of the aforesaid injury.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
