The petitioner seeks bail in connection with Sangrampur P.S. Case No. 170 of 2015 registered under Sections 302 and 34 of the I.P.C.

Learned counsel for the petitioner submits that petitioner is in custody since 15.01.2021 and charge-sheet has been submitted in the case and he is a person with clean antecedent. Learned counsel further submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that the informant alleges that deceased elder brother alongwith his sister, her sons and daughter and this petitioner (husband of the sister of the deceased) came in the night and

Patna High Court CR. MISC. No. 29846 of 2021(2) dt.24-11-2021 2/2 strangulated the deceased and despite informant plea to leave her husband, they committed the occurrence and thereafter hanged the dead body. Learned counsel for the petitioner further submits that the petitioner is own nandosi of the deceased and the informant who is wife of the deceased has falsely implicated the entire family members and wife of the petitioner namely, Bachi Devi @ Bachhi Devi, who is also co-accused of this case has been granted bail vide order dated 04.12.2019 passed in Cr. Misc. No.62297 of 2019. .

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is a person with clean antecedent, charge-sheet has been submitted in the case and co-accused has been granted bail, the petitioner, abovenamed, is directed to be released on bail on his furnishing bailbonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Ist Class, East Champaran, Motihari in connection with Sangrampur P.S. Case No.170 of 2015.
