2. The petitioner seeks regular bail in connection with Chiraiya P.S. Case No. 419 of 2019, registered under Sections 302/34 of the Indian Penal Code.

3. As per prosecution case, the marriage is of 10.07.2000. There are five children and one of them is disabled. It is stated that after four to five children Akbar Ali (petitioner) married again. Thereafter it is alleged that on 14.08.2019 he killed the first wife. The petitioner has five children and he naturally has to look after them.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Petitioner has clean antecedent and he is in custody since 05.12.2025.

5. Learned APP for the State has vehemently opposes the prayer for bail of the petitioner.

6. Considering that five children would be rendered guardian less as their mother is also not there as well as the fact that the trial has even not commenced and period of custody, this application is allowed.

7. Accordingly, let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned A.C.J. IVth, Sikrahna, East Champaran /concerned court below in connection with Chiraiya P.S. Case No. 419 of 2019.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
