JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-06-2020 Heard Mr. Anshu Dhar Sharma, learned Advocate for the petitioners and APP for the State. The petitioners seek bail in connection with Muffasil P.S. Case No. 33 of 2020 & Computer Registration No. 90 of 2020 dated 20.01.2020 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

87.75 litrest of liquor is stated to have been recovered from behind the house of the petitioners. The petitioners are said to be in custody since 01.03.2020.

It has been urged that the recovery is not from in closed space, but from an open area which could be accessible to any person.

Patna High Court CR. MISC. No.19236 of 2020(2) dt.03-06-2020 2/2 Considering the nature of accusation against the petitioners and their period of custody, they are directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 2nd cum Special Judge, Excise, Samastipur in connection with Muffasil P.S. Case No. 33 of 2020.
