NILU AGRAWAL ORAL ORDER 23-09-2015 Heard learned counsel for the petitioners Mr. Sanjay Kumar Bharti and learned A.P.P. for the State. The petitioners apprehend their arrest in connection with Khizarsarai P.S.Case No. 80/2009 registered for offences punishable under Sections 420,467, 468, 471/34 of the Indian Penal Code.

The prosecution case as stated by the informant, Arvind Kumar is that these two petitioners and other co-accused persons came to the house of the complainant in search of a marriageably boy for marriage of daughter of accused Chandra Deo Ravidas, the accused Ramdeo Das posed himself as a clerk in B.C.C.L. and also told that his Bhagina (accused Surendra Kumar) is an

Patna High Court Cr.Misc. No.38922 of 2015 (2) dt.23-09-2015 2/3 engineer in the B.C.C.L. It is alleged that the accused persons, on false pretext, to provide his son job in B.C.C.L., managed to take total Rs. 1,35, 000/- from him. But they could not provide any job to the informant or his relatives and also refused to return the money. Thus, the petitioners and other co-accused persons cheated the complainant.

It has been submitted by the learned counsel for the petitioners that the co-accused persons, namely, Deo Kumar Das, Chandradeo Ravidas and other accused persons, Ramdeo Ravidas having identical allegations have been granted privilege of anticipatory bail in Cr. Misc. No. 37878 of 2010 by order dated 04.03.2011, Cr. Misc. No. 37543 of 2009 vide order dated 21.12.2009 and Cr. Misc. No. 35254 of 2010 vide order dated 22.11.2010. The allegations on the petitioners are same and similar.

Under such circumstances, in case of arrest or surrender within a period of four weeks from today before the Court below, the above named petitioners, namely, Ajay Das and Raju Das @ Rajan Bharti be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only)each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Khizarsarai P.S.Case No.
