JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Kiul Rail P.S. Case No. 264 of 2018 registered for the offences punishable under Section 377 of the Indian Penal Code and Sections 6/7 of POCSO Act.

Allegation against the petitioner is of committing unnatural offence with the informant-victim, who was a minor boy.

Submission of learned counsel for the petitioner is that the whole case is false and concocted and realising the same both the parties have filed a compromise petition in the court below.

Heard learned APP also, who has opposed the prayer for anticipatory bail stating that apart from the allegation process under Sections 82 and 83 Cr.P.C. has already been

.In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. Let him surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

With the above observation, this application is dismissed.
