For the Petitioner : Mr. Yogesh Chandra Verma, Sr. Advocate.
Mr. Nafisuzzoha, Advocate.
For the Opposite Party : Mr. Nand Kumar, APP. ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 17-05-2017 Heard both sides.
The petitioner apprehends her arrest in Chousa P.S. Case No. 54 of 2014 registered for the offences punishable under Section 420 and other Sections of the Indian Penal Code. Allegation against the petitioner is that the petitioner produced fake mark sheet obtained in TET examination and got appointment on the post of teachers.
Learned counsel for the petitioner submits that similarly situated co-accused Khusbu Kumari @ Khushboo Kumari, Ranjeet Kumar and Priti Kumari have been granted anticipatory bail but, it appears that the prayer for anticipatory bail of the petitioner was rejected on 23.02.2015 vide Cr. Misc. No. 7423 of 2015. The petitioner did not surrender in the court below. The petitioner avoided to appear in court for more than 11⁄2 years and
Patna High Court Cr.Misc. No.14023 of 2017 (2) dt.17-05-2017 2/2 then filed this petition on the ground that similarly situated coaccused persons have been granted anticipatory bail. Considering the facts aforesaid and that even after rejection of the bail petition the petitioner did not appear for about two years, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J.) KKSINHA/- U T
