The petitioner seeks bail in Kanti P.S. Case No.233 of 2018 registered under Sections 400, 414 and 413 of the Indian Penal Code.

The police apprehended three persons namely, Manoj Kumar, Shambhu Choudhary and Raja Babu while they were fleeing away with the theft truck and Bolero. The learned counsel for the petitioner submits that two other accused persons, namely, Shambhu Choudhary and Manoj Kumar have been granted bail by different Bench of this Court vide Cr. Misc. No.50120 of 2018 and Cr. Misc. No.53723 of 2018. The case of the petitioner stands on the same footing and

Considering the facts that although the petitioner was apprehended while fleeing away with the looted truck but two similarly situated accused persons have been granted bail by this Court and petitioner is in jail since 12.05.2018, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M.(West), Muzaffarpur in connection with Kanti P.S. Case No.233 of 2018, G.R. No.1438 of 2018.
