The petitioners are languishing in custody since 13.02.2019 in a case registered for the offences punishable under Sections 147, 148, 149, 387, 307, 353, 504, 337 and 338 of the Indian Penal Code.
The prosecution case, as per the written report of Rajeev Kumar Patel, Station House Officer of Rajauli Police Station submitted to the Chief Judicial Magistrate, Nawada, is to the effect that on 12.02.2019, one trolley was seized when all the 19 FIR named accused persons including the petitioners
Patna High Court CR. MISC. No.19545 of 2019(2) dt.01-04-2019 2/2 came to the police station and raised slogan against the police officials and tried to take away the seized trolley. They also attacked on the police personnel.
It is submitted by learned counsel for the petitioners that the accusation is omnibus and general against the mob and a statement has been made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent. Learned APP submits that the petitioners are named in the FIR.
Considering the accusation being omnibus and general against the mob and statement being made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Rajauli P.S. Case No. 55 of 2019.
