JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-01-2022 At the outset, learned counsel for the petitioner prays for and is allowed to correct name of the petitioner as 'Bir Bahadur Mukhia' in place of 'Bir Bahadur Bhagat' in the bail petition. Accordingly, let the cause title of the order be corrected.
This matter is taken up for consideration through Video Conferencing.
The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 307/34 and other ancillary sections of the Indian Penal Code. As per the prosecution case, petitioner is alleged to have given Farsa blow on the head of the informant. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.31580 of 2021(3) dt.06-01-2022 2/2 petitioner is innocent and has falsely been implicated in this case. Parties are agnate and there is land dispute between them. There is case and counter case. One of the injuries of the informant has been found to be cut injury and there is no repetition of assault by the petitioner. Petitioner has claimed clean antecedent and he is in custody since 14.1.2021. Considering the aforesaid facts and circumstances of the case and period of custody, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate Raxaul, Motihari, East Champaran in Chhauradano Police Station Case No. 169 of 2020.
