2. The petitioner has preferred this application for grant of regular bail in connection with Siswan P.S. Case No. 290 of 2023 dated 04.11.2023 registered for the offences punishable u/ss 447, 341, 323, 324, 504, 506, 307 read with section 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have started abusing the informant's son due to previous enmity. When he protested, the co-accused Prakash Ram assaulted on his head with iron rod causing head injury. Thereafter, all the accused also assaulted him. It is further alleged that they also assaulted one Aslam Ali.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The specific allegation of assaulting the informant's son is against the co-accused Prakash Ram. There is general and omnibus allegation against the petitioner. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 18.12.2023.

Learned counsel for the informant as well as learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and stated that there is allegation of repeated blow on the head of the informant's son. It is further stated that the inquest report and the postmortem report also support the prosecution.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Siwan in connection with Siswan P.S. Case No. 290 of 2023, with a condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date,
