JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,307,384,386,427,504 and 506/34 of the Indian Penal Code and section 27 of the Arms Act.

The prosecution case is that on 24.3.2015 at 1 A.M. in the night while road construction work was going on, 8-10 miscreants came to the construction site, threw cement in water, looted iron rod and made indiscriminate fire as they were demanding extortion of rupees two lacs. It is further alleged that the accused persons gave life threatening for not making payment of extortion amount. It is alleged against the petitioner that he

Patna High Court Cr.Misc. No.38875 of 2015 (2) dt.01-10-2015 2/2 earlier gave threatening, hence it was suspected that the occurrence took place at the behest of the petitioner. It is submitted by the learned counsel for the petitioner that even assuming the accusation the petitioner was not present on the place of occurrence. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the suspicious nature of accusation, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa in connection with Bakhtiyarpur P.S. Case No.86 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
