JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 Petitioner seeks regular bail in connection with Amas P.S. Case No.216 of 2017 registered for the offences punishable under Sections 302, 201, 34 of the Indian Penal Code. As per complaint petition on the basis of which, F.I.R. was registered and there is allegation against the petitioner is of pushing his wife and causing her death.
Submission of the learned counsel for the petitioner is that this complaint petition has been lodged after six months of the occurrence and the petitioner has also lodged a case bearing U.D. Case No.06 of 2016 dated 23.12.2016. It has further been submitted that as a matter of fact, the deceased was assaulted her daughter, for which, the petitioner slapped his wife and due to that she died and as such, allegation against the petitioner is false and concocted and even the police after investigation has

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M., Sherghati Gaya, in connection with Amas P.S. Case No.216 of 2017, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
