This application, for grant of regular bail, arises out of Mohania Police Station Case No. 530 of 2019, disclosing offences under Section 395 of the Indian Penal Code. The allegation as per the First Information Report is that the five unknown accused persons intercepted the vehicle bearing No.UP72T-3797 and looted onion which was loaded on the said vehicle and it has further been alleged that subsequently vehicle was found abandoned near Mahavir Petrol Pump. Learned counsel for the petitioner submits that the petitioner has falsely been been implicated in this case on the

No.18706 of 2020(3) dt.30-01-2021 2/3 basis of his alleged confessional statement and he has been remanded in the present case from Kudra PS Case No.376 of 2019 on 21.01.2020. Learned counsel next submits that no incriminating material or looted articles have been recovered from the possession of the petitioner and similarly situated coaccused persons have been granted anticipatory bail by this Court in Cr. Misc. No.23663 of 2020 and Cr. Misc. No.26675 of 2020. Learned counsel next submits that the petitioner has not been put on test identification parade up-till-now. Having regard to the submissions made on behalf of the parties and taking into consideration the materials on record and the fact that the petitioner is in custody since 21.01.2020 and the chargesheet has already been submitted against the petitioner and there is no likelihood that the petitioner will abscond or tamper with the evidence and similarly situated accused persons have been granted anticipatory bail by this Court, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, Sonu Kumar Singh, be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
