JUSTICE SUDHIR SINGH ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Section 392 of the Indian Penal Code.

The allegation against the petitioner and other coaccused is that they looted Rs. 3 lacs from the dickey of the motor cycle and snatched Rs. 80,000/- from his friend Sunil Panjiar and Rs. 93,500/- from the pocket of the informant- Jitendra Purvey. It has been submitted on behalf of the petitioner that the petitioner is in custody since 06.06.2016. Charge sheet has been submitted in this case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the FIR. He has not been put on T.I. parade.There is no recovery of any incriminating article from his possession. Except

Patna High Court Cr.Misc. No.42393 of 2016 (2) dt.19-10-2016 2/2 for the confessional statement of co-accused, there is no other substantive evidence to suggest the implication of the petitioner in the present case. Other co-accused has been granted bail on 11.09.2015 vide Cr. Misc. No.41679 of 2015.

On behalf of the State, it has been submitted that the petitioner is not named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.,-IV, Rosera, Samastipur in connection with Singhiya P.S.Case No. 127 of 2014.
