JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-05-2019 This application, for grant of anticipatory bail, arises out of Chandauti P.S. Case No. 222 of 2018, disclosing offences under Sections 147, 149, 341, 323, 448, 427, 379, 504 and 506 of the Indian Penal Code.
Prosecution case is that accused persons found their electric wire detached from the pole and suspected that this has been done by the informant, on which, the accused persons including petitioners entered inside the house of informant and assaulted him and also taken away the articles. Submission of learned counsel for the petitioners is that they are villagers and the dispute arose between the parties on a trivial matter and no specific allegation has been attributed

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Chandauti P.S.
