JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 20-09-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Sherghati P. S. Case No. 271 of 2016 registered under Sections 272 and 273 of the Indian Penal Code and Section 47(a) of the Bihar Excise (Amendment) Act, 2016.

As per the prosecution case, seven bags of mahua flower each containing 50 kg. were being transported by the petitioner in an auto-rickshaw.

It is contended that the petitioner has got no criminal antecedent and is in custody since 14.06.2016. He has roots in the society and is not likely to abscond, if released on

Patna High Court Cr.Misc. No.39787 of 2016 (2) dt.20-09-2016 2/2 bail. It is also contended that since charge-sheet has already been submitted by the police after completion of investigation, his interrogation for collection of any further material is not required.

Learned counsel for the State has vehemently opposed the application for bail.

Regard being had to the nature of the offence and the period undergone in custody, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati, Gaya in Sherghati P.
