JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code.

According to prosecution case itself, petitioner happens to be driver of the vehicle from which stolen electric wire was recovered. Furthermore, the informant has admitted in his self statement that one person managed to escape from there and this petitioner being driver of the said vehicle was caught on the spot. Moreover, the first information report goes to show that petitioner disclosed before the informant that at the direction of owner of said vehicle, he got loaded the electric wire in the said vehicle.

Patna High Court Cr.Misc. No.40540 of 2016 (2) dt.03-10-2016 2/2 Petitioner does not have any criminal antecedent and is languishing in jail custody since 04.07.2016. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Pothiya P.S. Case No. 102 of 2016.
